A 66-year-old Huntersville man faces a second-degree murder charge after his wife died from injuries police say he inflicted during a domestic assault.
Huntersville Police Department officers responded to a home in the 12000 block of McGinnis Lane at approximately 6:37 p.m. on Tuesday, Sept. 22, after a call to assist paramedics, WSOC-TV reported. The address sits in a neighborhood off Eastfield Road.
When officers arrived, they found 65-year-old Sandra Porter, a resident of the home, unresponsive inside, according to Queen City News. She was transported to an area hospital in critical condition.
Investigators allege her husband, 66-year-old Cody Franklin Porter Jr., strangled her during the assault. He was arrested and charged with assault by strangulation, assault with a deadly weapon with intent to kill, and misdemeanor domestic violence.
Sandra Porter remained under medical care for nine days. She died Thursday, Oct. 1, from injuries sustained in the assault, according to the Charlotte Observer.
Detectives then upgraded Cody Franklin Porter Jr.'s charges to second-degree murder. The Huntersville Police Department said the new charge reflects the circumstances of the original assault, the victim's death and additional medical and investigative findings.
The department said no further information will be released because the investigation remains active and court proceedings are pending. No court date for Cody Franklin Porter Jr. has been announced.
Huntersville Police Detective Charlene Tombaugh is leading the case. Anyone with information can contact Tombaugh at 704-464-5509 or submit an anonymous tip to North Mecklenburg Crime Stoppers at 704-896-7867.
